Terms of Sale

These terms apply to any subscription purchase on looona.fr.

1. Scope

These Terms of Sale govern the purchase of paid plans for the Looona Cloud service, offered by Arnaud BLANCHARD CETOUTE at looona.fr.

Any order implies full acceptance of these Terms of Sale and the Terms of Use.

These Terms apply only to paid plans (Starter and Pro). The Free plan is provided at no cost and involves no commercial transaction.

2. Plans and Pricing

Plans and prices in effect are those displayed on the Pricing page at the time of subscription.

All prices are listed in euros (€) excluding taxes. Applicable VAT is calculated and added at checkout based on the buyer's country of residence, in accordance with applicable European regulations.

Arnaud BLANCHARD CETOUTE reserves the right to modify pricing at any time. Any price change will be communicated by email at least 30 days before taking effect. You may cancel your subscription without penalty before the new prices apply.

3. Subscriptions and Renewal

Subscriptions are taken out for a fixed period (monthly or annual) and renew automatically at the end of each period unless cancelled beforehand.

In the event of a failed payment at renewal, the workspace(s) associated with the subscription may be suspended until payment is resolved.

4. Payment

Payments are made online, securely, through our provider Dodo Payments. Accepted payment methods are those offered by Dodo Payments at checkout.

Arnaud BLANCHARD CETOUTE does not store any payment details. All transactions are processed by Dodo Payments under their own security policy.

Payment is due immediately upon subscription and at each subsequent automatic renewal date.

5. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content where execution has begun with the consumer's prior express agreement, who acknowledged waiving their right of withdrawal.

By subscribing to a paid plan and immediately accessing the service, you expressly acknowledge waiving your right of withdrawal for the current period.

Business customers (B2B) are not entitled to a right of withdrawal, which is reserved for consumers under the French Consumer Code.

6. Cancellation

You may cancel your subscription at any time from your account settings or by contacting [email protected].

Cancellation takes effect at the end of the current subscription period. Access to the service remains active until that date. No pro-rata refund is issued for the remaining period, except in exceptional cases at Arnaud BLANCHARD CETOUTE's discretion.

Arnaud BLANCHARD CETOUTE reserves the right to cancel a subscription in the event of a breach of the Terms of Use, with prior notice except in cases of force majeure or fraudulent activity.

7. Refunds

Subscriptions are non-refundable except in the following cases:

  • Extended, unplanned service unavailability attributable to Arnaud BLANCHARD CETOUTE (assessed on a case-by-case basis)
  • Duplicate billing or manifest payment error
  • Cancellation initiated by Arnaud BLANCHARD CETOUTE for reasons other than a breach of the Terms of Use

Refund requests must be sent to [email protected] within 30 days of the relevant invoice date.

8. Plan Changes

You may upgrade or downgrade your plan at any time from your account settings.

Upgrade: the change takes effect immediately. The price difference is calculated on a pro-rata basis for the remaining period.

Downgrade: the change takes effect immediately. Data exceeding the new plan's quotas may be limited or deleted.

9. Invoicing

An invoice is automatically generated for each payment. Invoices are accessible from the Dodo Payments customer portal, linked from your subscription management page.

10. Force Majeure

Arnaud BLANCHARD CETOUTE shall not be liable for failure to fulfil its contractual obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code (natural disaster, third-party infrastructure failure, cyberattack, etc.).

If force majeure persists beyond 30 days, either party may terminate the contract without penalty. You will then be refunded on a pro-rata basis for the unused period.

11. Governing Law and Disputes

These Terms of Sale are governed by French law. Any dispute regarding their interpretation or performance shall be submitted, failing an amicable resolution, to the exclusive jurisdiction of French courts.

For consumers residing in the European Union, the European Commission's online dispute resolution platform is available at consumer-redress.ec.europa.eu.

12. Consumer Mediation
